Journey Title: Peru Sacred Valley Experience 2026
Dates: August 31st to September 11, 2026
These Terms & Conditions (“Terms”) govern your booking and participation in the Journey. By paying any deposit or fee, you confirm you have read, understood, and agreed to these Terms.
1) Who We Are (Role & Scope)
1.1 Retreat Facilitator — Not a Travel Agency
The Journey is organized and led by Anthony Tatekawa (“we”, “us”, “Facilitator”) as a retreat facilitator and group coordinator, not as a travel agency, tour operator, airline, or ticketing agent.
We do not sell or charge for travel services (such as flights, passenger transport tickets, Machu Picchu entry tickets, or other tourism tickets). We provide retreat/facilitation services and coordinate certain on-the-ground elements via local third-party providers in Peru.
1.2 Third-Party Providers
Some services are delivered by third parties (e.g., accommodation partners, local transport providers, guides, site operators, ceremonial lineage holders). Where applicable, these are provided under the third parties’ responsibility and terms, and you agree that we are not liable for their acts/omissions beyond our own duty of reasonable care in selecting and coordinating.
2) What You Are Booking
2.1 Retreat Services Covered by Your Payment
Your payment covers participation in the Journey as described on the trip page (including facilitation, group process/integration spaces, retreat activities and Journey programming during the specified dates). The Journey includes multiple phases/options as shown on the website.
2.2 What Is Not Included (Participant Responsibility)
Unless explicitly stated as included on the website, the following are not included and are the participant’s sole responsibility:
- International flights and any additional domestic flights
- Travel insurance (required)
- Airport taxis/transfers not explicitly included
- Entry tickets and site permits (e.g., Machu Picchu entry, trains, archaeological sites), unless explicitly included
- Personal expenses (laundry, minibar, souvenirs, etc.)
- Vaccinations, medical costs, prescriptions
You must independently confirm passport validity, visas (if applicable), and compliance with all entry requirements for Peru.
3) Eligibility, Health, and Safety
3.1 Medical & Psychological Fitness
You confirm you are physically and psychologically fit to travel and to participate in retreat activities that may include hiking at altitude, long days, and emotionally intense processes.
You agree to provide truthful information during any health/safety screening and to notify us of relevant medical conditions, medications, or changes.
3.2 Plant Medicine / Ceremonial Work (If Applicable)
Where the Journey includes ceremonial work facilitated by traditional lineage holders, participation may involve heightened physical and psychological intensity. You accept these risks and agree to follow all safety instructions (dietary preparation, contraindications, behavioral agreements, and facilitator guidance).
You are solely responsible for ensuring your participation complies with:
- your medical contraindications and medication interactions,
- your home-country professional/licensing obligations (if relevant),
- local laws and regulations.
3.3 Zero Tolerance: Safety & Conduct
We reserve the right to remove any participant, without refund, if behavior endangers self/others or disrupts the container (e.g., violence, harassment, repeated boundary violations, intoxication contrary to agreements, non-compliance with safety guidance).
4) Booking, Payments, and Pricing
4.1 Deposit and Final Payment
- A 30% deposit is required to reserve your spot.
- Final payment is due by July 31, 2026.
- Your booking is not confirmed until the deposit is received and you receive written confirmation.
4.2 Late Payment
If final payment is not received by the deadline, we may treat your booking as cancelled by you (see cancellation policy), and your spot may be released.
4.3 Fees and Payment Processing
If a payment processor charges fees (e.g., card processing), any refunds may be net of non-recoverable processing fees, where permitted by law.
5) Cancellation & Refund Policy
This policy reflects common European retreat practice for date-specific services and the reality of pre-paid supplier commitments.
5.1 Participant Cancellation (You Cancel)
All cancellations must be submitted in writing (email) and are effective on the date received.
Deposit (30%)
- The deposit is non-refundable, except where mandatory local consumer law applies.
Refund schedule for amounts paid beyond the deposit
If you cancel:
- More than 90 days before Sept 1, 2026: refund 70% of amounts paid beyond the deposit
- 90 to 61 days before Sept 1, 2026: refund 50% of amounts paid beyond the deposit
- 60 to 31 days before Sept 1, 2026: refund 25% of amounts paid beyond the deposit
- 30 days or less before Sept 1, 2026: no refund
No-shows / early departure: no refunds.
Rationale: the closer to departure, the less likely we can re-fill the spot and the more costs are committed to local providers.
5.2 Transfer to Another Participant
You may request to transfer your booking to another person (one transfer), subject to:
- the replacement participant completing required screening and agreeing to these Terms,
- payment of any admin fee (optional), and
- no conflict with supplier name-change policies (trains/tickets may be non-transferable).
5.3 Cooling-off / Right of Withdrawal (EU distance sales)
Where EU consumer rules apply, note that services related to leisure activities scheduled for a specific date or period can be exempt from the 14-day withdrawal right. Your booking is for a date-specific retreat service.
5.4 If We Cancel the Journey
We may cancel due to force majeure, safety concerns, or insufficient participants. If we cancel, we will refund the retreat fees paid to us for the Journey.
We are not responsible for your external costs (e.g., flights, insurance, visas, personal bookings, non-refundable tickets), and we strongly recommend insurance that covers cancellation and disruption. (This mirrors standard retreat industry policies.)
6) Force Majeure (Events Outside Control)
We are not liable for delays/changes/cancellation caused by events outside reasonable control (e.g., natural disasters, strikes, pandemics, governmental actions, civil unrest, severe weather, transport shutdowns).
In such cases, we will make reasonable efforts to:
- offer an alternative schedule, or
- offer a credit/voucher (where feasible), or
- refund only what is recoverable after non-refundable supplier commitments (depending on circumstances).
7) Travel & Personal Insurance (Required)
Travel insurance is required and must, at minimum, cover:
- medical treatment abroad,
- emergency evacuation,
- trip cancellation/interruption,
- high-altitude travel (if applicable).
The website states travel insurance is not included and is required.
8) Assumption of Risk & Liability Waiver
8.1 Assumption of Risk
You acknowledge travel in Peru and participation in retreat activities carries inherent risks (altitude sickness, accidents, illness, transport incidents, emotional distress, etc.). You voluntarily assume these risks.
8.2 Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for indirect or consequential losses (loss of enjoyment, loss of income, missed flights, etc.).
- Our liability is limited to the amount you paid to us for the retreat services.
Nothing in these Terms limits liability where exclusion is not permitted by law (e.g., gross negligence, fraud, or certain consumer protections).
9) Not a Package Travel Contract
This Journey is offered as a retreat facilitation service with coordination of certain elements through local providers. It is not marketed as a “package holiday” sold by a tour operator.
EU rules distinguish “package travel” where multiple travel services are combined and sold under one contract by a trader.
10) Changes to Itinerary
We may adjust the itinerary when necessary for safety, weather, local conditions, or operational constraints. We will aim to preserve the core intent and comparable value.
11) Media, Privacy, and Confidentiality
- Confidentiality: group sharing spaces require confidentiality (no sharing personal stories of others without explicit consent).
- Media: photos/videos may be taken; you may opt out. We will not publish identifiable media without consent unless you explicitly agree.
- Data: booking/admin data handled per the website’s privacy policy.
12) Governing Law & Dispute Resolution
These Terms are governed by the laws of Spain (or your operating jurisdiction), and disputes will be subject to the courts of Barcelona, Spain, unless mandatory consumer law in your country of residence provides otherwise.
